Acceptance of Terms

This website (the “Site”) is owned and operated by Alembic Therapeutics LLC ("Company," "we," "us," or "our"). Your access to, browsing of, and use of the Site, including any information, materials, services, or functionality made available through the Site, are subject to these Terms of Use ("Terms") and all applicable federal, state, and local laws and regulations.

By accessing, browsing, or otherwise using the Site, including by submitting information through the Site, you acknowledge that you have read, understand, and agree to be bound by these Terms without limitation or qualification. If you do not agree to these Terms, you must immediately discontinue access to and use of the Site.

These Terms govern only your access to and use of the Site and do not modify, amend, or supersede any other written agreement you may have with the Company, including any agreement governing the use of Company products or services.

Prohibited Uses

The Company reserves the right, but not the obligation, to review, monitor, remove, or refuse to post any Submissions at its sole discretion.

DMCA Notice

If you believe that any material on the Site infringes your copyright, you may submit a written notification pursuant to the Digital Millennium Copyright Act (“DMCA”). To be effective, a DMCA notice must include all information required under 17 U.S.C. § 512(c)(3), including identification of the copyrighted work, identification of the allegedly infringing material, and contact information for the complaining party.

Except for claims seeking injunctive or equitable relief relating to the protection or enforcement of intellectual property rights, confidentiality obligations, or Site security, any dispute, claim, or controversy arising out of or relating to your use of the Site or these Terms shall be resolved exclusively through final and binding arbitration on an individual basis, rather than in court. Arbitration shall be administered by the American Arbitration Association in accordance with its applicable rules.

You agree that any arbitration shall be conducted on an individual basis and that you waive any right to participate in a class, collective, or representative action or proceeding, including a class action or jury trial.

Governing Law

These Terms and any dispute arising out of or relating to them are governed by the laws of the State of New Jersey, without regard to conflict-of-laws principles.

Termination
